Introduction

Rather than require an email address and/or other contact information to download this ebook I have placed it, in its entirety, on this site. I have also provided a link to download the ebook in pdf format (right click on the link and choose “save target as”) if you wish to read it at your leisure. After you are stopped for DUI you may be upset, scared and confused about what will happen next.  This is particularly true if you were released by the police and told that you will “receive information in the mail”. In my years as a DUI Prosecutor and DUI defense attorney I have answered many questions about DUI charges. I have now put the most common questions that I am asked into this book in question and answer form to help clarify some of these issues for those who have been stopped for a DUI in Pennsylvania. I also offer a Free Consultation on all DUI cases. I can be reached at 412-521-2628 or through the contact form at the bottom of the page

Table of Contents

The DUI Stop

Did the Police Officer have the right to stop me and if not what will happen to my DUI case? The Officer did not read me my rights – will the charges be thrown out? Why did the officer give me a breath test on the side of the road and then require me to submit to another breath or blood test? What are Field Sobriety Tests (FST’s) and how are they graded? I refused to submit to the breath or blood test  – what are the consequences of this? Why did the Police Officer release me instead of taking me to jail?

What to expect after the DUI stop

The Police Officer just let me go – what happens now? What will I receive in the mail from the Magistrate? When will I find out what my Blood Alcohol Content (BAC) was?

The Charges

How can I be charged with DUI if the police don’t know my BAC yet? Can I be charged with DUI for driving with a legally prescribed medication in my system? Can I be charged with DUI for driving with an illegal drug in my system? Can I be charged with DUI for driving with a combination of alcohol and drugs in my blood? Can I be charged with DUI for driving with a non-prescription drug in my system?

The Preliminary Hearing

What is the purpose of the Preliminary Hearing? What will happen if my BAC results are less than .08%? At the Preliminary Hearing will I be able to plead  guilty to a lesser offense like reckless driving?

Driver’s License Suspension

Are DUI related Driver’s License Suspensions negotiable? Will I have my driver’s license suspended no matter what?

DUI Mandatory Sentences

What are DUI mandatory sentences? How are DUI mandatory sentences calculated? Will I have to go to jail no matter what? Accelerated Rehabilitative Disposition (ARD)

What is ARD?

What are the requirements for admission to the ARD program? What will I have to do in the ARD program? What Happens when I finish ARD?
